Drucilla E. Bell, P.A. Immigration Law

HOMELAND SECURITY IS NOT EASY TO CONTROL

As part of her international business service to clients, Ms. Bell assists in all aspects of business transition around the world. If you wish to expand your business into the United States, she will assist and advise on the appropriate business entity, form and register it appropriately with both the state government and the IRS. She can also assist in finding appropriate professionals to assist in setting up your business, and she will assist in structuring your business to take advantage of US immigration laws.

Once the business is formed and registered, it will be time to come to the United States and start the business operating toward a profitable future. Ms Bell can then develop, gather and structure the documentation to support the visa necessary to allow you to start your business in full operation. If you choose a business that is difficult to start from scratch, then in order to reach profitability quicker, it may be better to buy an already existing and profitable business, that can show the necessary profit, to obtain Legal Permanent Residency (green card).

If you wish to invest in a business in the US and get an investor's visa or extend your business to the United States through an existing business and work toward permanent residency, Ms. Bell can assist in structuring and documenting the arrangement appropriately.

Are you a Canadian who never thought of yourself as an "alien"??
Do you have a business in the US but never thought about a visa until recently, when someone mentioned that Canadians would soon need passports and visas to cross the border ?? Ms. Bell has already assisted some nervous Canadians with restructuring their US business to make it legal and give them a basis for permanent residency in a year or so. Call Ms. Bell and tell her your business situation - with some planning and re-allocation of resources, your business also may be brought into compliance.

Are you an alien who needs assistance in processing ?

Some people like to think of immigration as just filling out forms.  It can be very easy, like flying an airplane, but also like flying an airplane, mistakes can have serious irreversible consequences.  Since September 11, 2001, all the filings are examined more carefully.  There are many new officers and the newly trained have checklists that must be completely filled out.  This can result in rejection and denial of applications and petitions that would have been approved in the past.  Rules that were ignored in the past are strictly enforced now and the new rules and interpretations often confuse those who do not deal regularly with the process.  New security procedures have doubled processing times, while the agency is working to get all processing times to six months.

As Vice Chair of the Immigration Law Committee of the Florida Bar, Ms. Bell is one of the few attorneys who can deal directly with Immigration representatives at the Texas Service Center and the National Benefits Center to find out the status of your case, what USCIS needs, what is taking so long, if it can be expedited.  She also keeps current on changes in personnel, procedures, new developments in procedures and how to get USCIS' attention in special cases.

DO YOU HAVE A POSSIBLE DEPORTATION ISSUE ?

Recently, a large area of Ms. Bell's practice has become DEPORTATION, preventing it as often as possible, depending on the factual situations, from the KROME Detention Facility, and arranging bail for alien inmates whenever possible.  CALL HER AS SOON AS THE ARREST IS MADE !  She must get authorization to represent them as soon as they get to Krome, or they will be shipped to Texas, to be deported.  Although many of these aliens have merely overstayed their visas (which is now a crime), there are also those who have old criminal convictions that may cause their removal from the US.  Crimes involving moral turpitude, felonies involving guns, drugs or domestic battery may be grounds for the perpetrator to be deported, even with completed sentences.  In some cases, these convictions can be reversed or reduced by re-opening the case, and allow the alien to remain and possibly become a citizen.  Recently, Ms. Bell obtained Legal Permanent Residency for a Jamaican fellow who had a cocaine conviction from 1990 and in two cases, she successfully sued the Department of Homeland Security to get citizenship for a middle eastern and Colombian person whom USCIS had delayed for over two years.
