Travel and Tourism Law is a relatively new area of the law and has become more important with the challenges to travel agency business by the internet, but the real exacerbater in this area was the de-regulation of the airline industry. It has become more and more important for travel agents and agencies to reduce their liability to travelers just as it had become increasingly important for travelers to know their rights. Sometimes even more important is to know who is liable, when the reservations are cancelled, the plane doesn't take off on time, the connection is missed or the late plane makes you miss your cruise ! All exasperating situations - but who to blame? What is the potential liability, and against whom ?

Ms. Bell is a member of the International Forum of Travel and Tourism Advocates. She attended the Eleventh Annual Conference in Ft. Lauderdale and presented a paper on Travel Regulation in Developing Democracies, using Estonia and Russia as her examples. The attendees, representing a dozen foreign countries, Canada and US cruised to Cozumel, where they enjoyed the ruins, swam in a cool cove and returned to the ship, to meet, argue and enjoy dining and entertainment. In this area, it is important to have an understanding of admiralty law and international law. For instance, under European Union law, travel agents are held to a strict liability standard. So if you are booking a group from Germany for a cruise, if the cabins they book are not available when they arrive, you as the travel agent could be held liable. For the rest of the world, it may also be a good idea NOT to promise a calm, sunny cruise or snow in Colorado! What kind of waivers should you have customers sign? What notices to customers can make those nasty lawsuits more difficult to win? What kind of medical preparation do you tell your sickly client to make? NONE - you tell them to see their doctor !

The Travel Law courses developed by Seminars at Sea Travel, Inc. and taught by Ms. Bell and Laurence Gore are geared to just these questions, along with issues involved in buying and selling a travel agency. The Travel Law course, along with "Memories of the Titanic" for CLE credit were offered on the SS Norway transatlantic cruise in April, 1998, see SS Norway photos.  Travel law courses are given on many Caribbean cruises.
